H.J.Res. 102 — Proposing an amendment to the Constitution of the United States providing that the Senate is made more representative by adding twelve Senators to be elected using a national popular vote, and providing for twelve Electors at-large for President and Vice-President, who shall cast their ballots for the respective winners of the national popular vote.

This section proposes a constitutional amendment that would add 12 Senators at-large to the Senate, elected nationwide by popular vote for 6-year terms, with each Senator at-large having 1 vote and meeting the same age and citizenship requirements as other Senators. It would divide the 12 at-large seats equally among the 3 Senate classes, so that 4 seats would be elected every 2 years, and require the first election of Senators at-large to occur no later than the second regularly scheduled general election for Federal office after ratification, with 4 of the 12 seats on the ballot at that election. This section also establishes a vacancy-filling process for Senators at-large. Within 30 days after a vacancy occurs, the governor or other executive authority of the State where the departing Senator at-large last resided would appoint a replacement from the same political party as the departing incumbent, or from a different party name affiliated with the same State-level party. If the seat is not scheduled for election at the next regularly scheduled general election for Federal office after a delay period that Congress would set by law, a special election would be held at that general election to fill the remainder of the term. This section defines eligible electors for Senators at-large as U.S. citizens who are at least 18 years old, registered to vote by their State’s deadline, and otherwise eligible under State law to vote in a general Federal election. It would require States to administer the elections, while Congress would establish the procedures and designate a Federal entity to collect State tabulations, count the votes, and announce the winners. It would also apply the article’s references to States and their electors to U.S. territories and the District of Columbia. This section further proposes 12 at-large presidential electors, to be appointed in a manner Congress would set by law. These electors would have the same powers and duties as other presidential electors, except that they would meet in the District of Columbia and cast their ballots for the presidential and vice-presidential candidates receiving the greatest number of votes cast by U.S. citizens. The 12 at-large electors would be counted in determining the total number of electors under the Twelfth Amendment. Finally, this section grants Congress authority to enforce the article through appropriate legislation.
