H.J.Res. 108 — Proposing an amendment to the Constitution of the United States providing that there is no immunity from criminal prosecution for an act on the grounds that such act was within the constitutional authority or official duties of an individual, and providing that the President may not grant a pardon to himself or herself.

This section makes no substantive change.

This section proposes a constitutional amendment that would eliminate immunity from criminal prosecution for Federal officers, including the President and Vice President, and for Senators and Representatives, for violations of otherwise valid Federal law and, unless the conduct was authorized by valid Federal law, for violations of State law based solely on the claim that the conduct was within the conclusive and preclusive constitutional authority of the office or related to official duties, except for Senators and Representatives acting under Article I, section 6, clause 1. It also would bar the President from granting a reprieve or pardon to himself or herself for offenses against the United States and would make the amendment self-executing while authorizing Congress to enact implementing legislation.
