This section establishes a constitutional process for congressional review of presidential reprieves and pardons by requiring the President to notify the President pro tempore of the Senate and the Speaker of the House within 3 days of granting a reprieve or pardon, allowing Congress to introduce a bill to nullify the action within 30 days of receiving notice, and permitting passage of a nullification bill within 60 days by a two-thirds vote of both Houses. It provides that, if Congress does not pass a nullification bill, the reprieve or pardon becomes effective 90 days after the President’s notice, and that any nullification bill signed by 20 Representatives or 5 Senators must receive a vote. It also terminates any reprieve or pardon that is not reported to Congress within 3 days, prohibits the President from granting a reprieve or pardon for an offense previously nullified by Congress, and grants Congress authority to enforce the article through appropriate legislation.
