This section proposes a constitutional amendment redefining "subject to the jurisdiction of the United States" under the 14th Amendment (which currently grants citizenship to all persons born in the U.S. and subject to its jurisdiction, with exceptions such as children of diplomats) to limit birthright citizenship to individuals born in the United States to at least one parent who is (1) a U.S. citizen or national, (2) an alien lawfully admitted for permanent residence whose residence is in the United States, or (3) an alien with lawful status performing active service in the Armed Forces. (Thus, children born in the U.S. to undocumented immigrants or non-permanent visa holders—absent a qualifying parent—would not automatically receive citizenship.) The amendment authorizes Congress to enforce it through legislation and becomes effective upon ratification by legislatures of three-fourths of the states within seven years of submission.
