H.R. 1012 — Spent Fuel Prioritization Act of 2025

This section establishes the short title as the “Spent Fuel Prioritization Act of 2025.”

This section directs the Secretary of Energy, when determining the order for accepting high-level radioactive waste and spent nuclear fuel for disposal or storage under 42 U.S.C. § 10222(a), to prioritize waste and fuel from civilian nuclear power reactors based on four factors: reactor operating status, local population, earthquake hazard, and national security risk. It gives highest priority to reactors that are (1) decommissioned or decommissioning, (2) located in the most populous area, (3) located in the area with the highest earthquake hazard as shown on the Seismic Hazard Maps published by the U.S. Geological Survey under section 5(b)(3)(J) of the Earthquake Hazards Reduction Act of 1977, and (4) located in an area that the Secretary, in consultation with the Secretary of Defense and the Secretary of Homeland Security, determines poses a significant national security concern because of continued on-site storage.
