§2. Rules for housing or transportation based on gender; limitation on gender-affirming care
This section establishes rules for the Bureau of Prisons to house and transport prisoners based on biological sex and prohibits the Bureau from furnishing or paying for gender-related medical treatment. It requires the Bureau to place a prisoner, during the term of imprisonment, only among prisoners of the same biological sex and to transport a prisoner, when moved with other prisoners, only among prisoners of the same biological sex. It also bars the Bureau from paying for or providing gender-related medical treatment, defined to include specified surgeries, exogenous hormones, puberty blockers, and other treatments provided to address a prisoner’s perception that the prisoner’s sex is not male or female, while excluding treatment for disorders of sex development, ambiguously sexed characteristics, or conditions caused or worsened by prior gender-related medical treatment.
