H.R. 102 — American Sovereignty and Species Protection Act of 2025

This section establishes the short title of the Act as the “American Sovereignty and Species Protection Act of 2025.”

This section limits the Secretary of the Interior’s authority under the Endangered Species Act of 1973 to list species by prohibiting a determination that a species is endangered or threatened under 16 U.S.C. § 1533 if the species is not native to the United States. (Thus, nonnative species could not be listed under section 4(a), even if they otherwise met the statutory listing factors.) This section also revises the financial assistance authority under 16 U.S.C. § 1537(a) by (1) redesignating the existing introductory text as paragraph (1), (2) striking language that expressly included the acquisition, by lease or otherwise, of lands, waters, or interests therein, and (3) adding a new paragraph (2) that prohibits any financial assistance provided under paragraph (1) from being used to acquire, by lease or otherwise, lands, waters, or other interests in a foreign country. (Thus, section 8(a) assistance could no longer be used for land acquisition outside the United States.)
