H.R. 1035 — Job Protection Act

This section establishes the short title of the Act as the “Job Protection Act.”

This section expands eligibility for family and medical leave for congressional employees by reducing the service requirement to 90 days (from 12 months and at least 1,250 hours of employment during the previous 12 months) under 2 U.S.C. 1312(a)(2)(B). (Thus, a covered congressional employee would qualify for leave after 90 days of employment rather than after meeting both the 12-month and 1,250-hour thresholds.)

This section expands the Family and Medical Leave Act’s employer coverage by revising the definition of “employer” to apply to employers with 1 or more employees, instead of only employers with 50 or more employees. (Thus, the Act’s leave requirements would apply to all employers covered by the provision, rather than only larger employers.)
