H.R. 1068 — PLCAA Federal Jurisdiction Act

This section establishes the short title of the Act as the “Protection of Lawful Commerce in Arms Act Federal Jurisdiction Act” or the “PLCAA Federal Jurisdiction Act.”

This section expands the Protection of Lawful Commerce in Arms Act by adding a new removal-and-dismissal procedure for qualified civil liability actions. It allows a defendant that is a manufacturer, seller, or trade association to remove a State-court civil action to the federal district court for the district and division where the case is pending if the defendant asserts that the action is a qualified civil liability action. The federal district court may then determine whether the case is a qualified civil liability action and dismiss it accordingly.
