H.R. 1104 — Unborn Child Support Act

This section provides the short title of the Act as the “Unborn Child Support Act.”

This section limits the Secretary of Health and Human Services’ waiver authority under section 1115 of the Social Security Act (42 U.S.C. 1315) for child support enforcement demonstrations by prohibiting any experimental, pilot, or demonstration project under part D of title IV from modifying section 454(4)(A)(ii) or new section 454(35) to establish and enforce child support obligations for an unborn child. (Thus, States may not use a section 1115 waiver to test child support policies for unborn children.) The limitation applies to projects under part D of title IV and takes effect 2 years after enactment, applying to payments for calendar quarters beginning on or after that date.
