H.R. 1107 — Protecting Veteran Access to Telemedicine Services Act of 2025

This section provides the short title of the Act as the “Protecting Veteran Access to Telemedicine Services Act of 2025.”

This section establishes authority for covered Department of Veterans Affairs health care professionals to use telemedicine to deliver, distribute, or dispense a controlled substance that is a prescription drug to a patient eligible for medical treatment under title 38, United States Code, even if the professional has not conducted an in-person medical examination of the patient. The authority applies only if the professional is authorized to prescribe the basic class of the controlled substance under an active, current, full, and unrestricted State license, registration, or certification, is acting in the usual course of professional practice, and the substance is provided for a legitimate medical purpose. This section directs the Secretary of Veterans Affairs to issue regulations establishing guidelines and a process for telemedicine delivery, distribution, and dispensation of controlled substances under this authority. It also provides that the new section does not remove, limit, or otherwise affect any obligation of a covered health care professional under the Controlled Substances Act. This section defines “covered health care professional” to include: (1) certain Department employees appointed under 38 U.S.C. §§ 7306, 7401, 7405, 7406, or 7408, or under title 5, who are not contractors, are authorized by the Secretary to provide health care under chapter 17, must follow Department quality standards, and must hold an active, current, full, and unrestricted license, registration, or certification or meet Secretary-established qualification standards within a specified time frame; and (2) health professions trainees appointed under 38 U.S.C. § 7405 who are under clinical supervision. It also incorporates the Controlled Substances Act definitions of “controlled substance,” “deliver,” “dispense,” and “distribute.”
