H.R. 1142 — To amend the Public Health Service Act to direct the Secretary of Health and Human Services to establish drug adherence guidelines, and for other purposes.

This section establishes a new section 1712 of the Public Health Service Act directing the Secretary of Health and Human Services to create drug adherence guidelines aimed at achieving 90 percent adherence for all Medicare Part B and Part D drugs. As background, Medicare Part B covers physician-administered drugs and biological products, and Medicare Part D covers outpatient prescription drugs. In developing the guidelines, the Secretary must incorporate artificial intelligence and machine learning technologies and, to the maximum extent practicable, promote the use of generic and biosimilar drugs. The section defines a Medicare Part B drug as a drug or biological product payable under Medicare Part B and a Medicare Part D drug as a covered Part D drug under 42 U.S.C. 1395w–102(e).
