H.R. 1164 — Fair Disaster Assistance Act of 2025

This section establishes the short title of the Act as the “Fair Disaster Assistance Act of 2025.”

This section directs the Administrator of the Federal Emergency Management Agency to issue regulations ensuring that an applicant for assistance under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5174) who has reported owning an insurance policy for a home or facility damaged by a major disaster does not receive a notice denying assistance before the insurer has made a final determination on the related claim. (Thus, FEMA may not issue a denial notice based on the existence of insurance coverage before the insurance claim is approved or denied.)
