H.R. 1167 — Keep China Out of Solar Energy Act of 2025

This section provides the short title of the Act as the “Keep China Out of Solar Energy Act of 2025.”

This section directs the Director of the Office of Management and Budget, in consultation with the Administrator of General Services, to issue standards and guidelines within 180 days of enactment requiring executive agencies to prohibit the use of Federal funds, including through contracts, subcontracts, grants, and subgrants, to procure solar panels manufactured or assembled by a covered foreign entity and to prohibit the use of Government-issued purchase cards for that purpose. It also directs the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation within 180 days of enactment to implement the contract and subcontract prohibition.

This section establishes a waiver process from the bill’s prohibition on covered solar panels for an executive agency if the agency head certifies to the Secretary of State and the Secretary of Homeland Security that the covered entity is the only viable source for the panels and both Secretaries jointly approve the request. It also requires the requesting agency to notify the Director of the Office of Management and Budget, who must submit quarterly reports to the appropriate congressional committees listing each waiver request and whether it was approved or rejected; the appropriate congressional committees are the Senate Committee on Foreign Relations and Committee on Homeland Security and Governmental Affairs and the House Committee on Foreign Affairs, Committee on Homeland Security, and Committee on Oversight and Government Reform.

This section directs the Comptroller General of the United States to submit to Congress, not later than 275 days after enactment, a report on the amount of solar panels procured by Federal departments and agencies from covered entities.

This section directs the Director of the Office of Management and Budget, not later than 1 year after enactment, to seek a contract with a federally funded research and development center to conduct a study of the domestic solar panel production market, the market’s ability to keep pace with technological advancements, and the global supply chain and workforce involved in solar panel production. It also requires the Director to submit the study to specified Senate and House committees not later than 30 days after receiving it.

This section defines “executive agency” by cross-reference to section 133 of title 41, United States Code, which includes an executive department, a military department, an independent establishment, and a wholly owned Government corporation fully subject to chapter 91 of title 31.
