H.R. 118 — No Federal Funds for Political Prosecutions Act

This section establishes the short title of the Act as the “No Federal Funds for Political Prosecutions Act.”

This section limits the use of equitable sharing funds and forfeited property transferred under 21 U.S.C. § 881(e), 18 U.S.C. § 981, and 28 U.S.C. § 524 by State and local law enforcement agencies with authority to prosecute criminal cases. It prohibits those agencies from using such funds or property to investigate or prosecute the President, Vice President, a former President or Vice President, or a candidate for President, and requires each covered agency to certify to the Attorney General that it will comply with that restriction. It also authorizes the Attorney General to disqualify an agency that fails to comply, in which case the Attorney General may not transfer any seized and forfeited property, or proceeds from its sale, to that agency under those authorities. For purposes of this section, “candidate” has the meaning given in section 301 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30101).
