H.R. 1182 — Compressed Gas Cylinder Safety and Oversight Improvements Act of 2025

This section establishes the short title of the Act as the “Compressed Gas Cylinder Safety and Oversight Improvements Act of 2025.”

This section revises the approval process for foreign manufacturers of cylinders (FMOCs) that make cylinders outside the United States for use in transporting hazardous materials in U.S. commerce. It defines an FMOC as an entity manufacturing cylinders intended to be represented, marked, certified, or sold as qualified for hazardous materials transport in the United States, and defines “in good standing” to require approval under 49 C.F.R. § 107.807 and 3 years of compliance with 49 C.F.R. part 107 and chapter 51 of title 49, United States Code. This section limits standard FMOC approvals to 1 year, but authorizes the Secretary of Transportation to grant a 5-year approval if the FMOC attests that none of its cylinders are prohibited from entry under section 307 of the Tariff Act of 1930 (19 U.S.C. 1307), certifies that its application information is accurate and that it will notify the Secretary of material changes, and is determined to be in good standing. It also authorizes the Secretary to suspend or terminate an approval if the FMOC obstructs an inspection under 49 C.F.R. § 107.807(c) or knowingly or intentionally misrepresents required information. This section directs the Secretary, within 1 year after enactment, to establish a process for interested parties to request reevaluation of an FMOC approval based on evidence of inaccurate, changed, or fraudulent attestations or responses. It also requires the Secretary to publish notice of each FMOC application on the Pipeline and Hazardous Materials Safety Administration website and provide a 30-day public comment period before approval. This section further requires FMOC applicants to answer additional questions about whether the applicant or any entity controlling more than 10 percent of the FMOC has been subject to civil monetary penalties under title 49, has delinquent penalties or fees under title 49, is subject to the Do Not Pay Initiative under 31 U.S.C. § 3354, is listed on the Department of Commerce Military End User List, is identified under section 1237 of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999, or has been found guilty of, or assessed, penalties under section 1760 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019.
