H.R. 1184 — Stop CCP Land Act

This section establishes the short title of the Act as the “Stop China’s Continuous Purchase of Land Act” or the “Stop CCP Land Act.”

This section conditions a State’s eligibility to receive specified Inflation Reduction Act funds on the State, beginning 1 year after enactment, having a law in effect that (1) prohibits each covered foreign country, or a person acting on behalf of a covered foreign country, from purchasing agricultural land in the State and (2) requires persons from a covered foreign country that already hold agricultural land in the State to submit annual reports to the State department of agriculture, or equivalent, regarding those holdings. As background, the referenced Agricultural Foreign Investment Disclosure Act of 1978 (AFIDA) requires reporting of foreign investment in U.S. agricultural land under 7 U.S.C. § 3508, and this section uses AFIDA’s definitions of “agricultural land” and “foreign person” for these restrictions. This section also directs the Secretary of Agriculture, not later than 1 year after enactment, to report to Congress on how AFIDA should be updated to improve documentation and monitoring of foreign investment in agricultural land, and directs the Comptroller General, not later than 90 days after enactment, to report on the Act’s national security impact and additional measures to secure U.S. real estate from foreign manipulation. It defines “covered foreign country” to mean a country on the State Department’s Defense Trade Control Country Policies List, including Russia, and defines “covered program funds” as funds made available under Public Law 117-169 for 18 specified programs and activities, including conservation, forestry, home energy rebates, climate resilience, and related assistance programs.
