H.R. 1186 — CREEPER Act 2.0

This section establishes the short title of the Act as the “Curbing Realistic Exploitative Electronic Pedophilic Robots Act 2.0” or the “CREEPER Act 2.0.”

This section sets forth congressional findings that possession of obscene dolls and robots is correlated with child pornography, that the devices can be customized to resemble actual children and simulate rape, and that their use may normalize sexual abuse of minors and facilitate exploitation, objectification, and rape of children.

This section expands the federal prohibition on importing or transporting obscene materials in interstate or foreign commerce under 18 U.S.C. § 1462 to include “any child sex doll.” It also defines “child sex doll” as “an anatomically correct doll, mannequin, or robot, with the features of, or with features that resemble those of, a minor, intended for use in sexual acts.” (Thus, the existing penalties of up to 5 years’ imprisonment for a first offense and up to 10 years’ imprisonment for each subsequent offense would apply to the importation or transportation of child sex dolls.)

This section establishes a new federal offense for trafficking in child sex dolls under chapter 71 of title 18, United States Code. It prohibits knowingly buying, selling, delivering, or distributing a child sex doll in interstate or foreign commerce, possessing a child sex doll that has been so trafficked, or possessing such a doll with intent to engage in trafficking conduct. A first offense is punishable by a fine, imprisonment for not more than 5 years, or both, and each subsequent offense is punishable by a fine, imprisonment for not more than 10 years, or both. The section defines “child sex doll” by reference to 18 U.S.C. § 1462.
