H.R. 120 — No Mandates Act

This section provides the short title of the Act as the “No Mandates Act.”

This section limits the authority of any agency, as defined in 5 U.S.C. § 551, to issue any rule, regulation, or guidance requiring any individual to receive a COVID-19 vaccination. (Thus, it prohibits federal agencies from imposing COVID-19 vaccine mandates through regulatory or guidance documents.)

This section prohibits requiring proof of COVID-19 vaccination as a condition of access to Federal property, Federal services, congressional grounds, or congressional services. (Thus, individuals may not be denied entry to those Federal facilities or services based solely on their COVID-19 vaccination status.)

This section prohibits any entity that received Federal funds under a COVID-19 relief package, or that receives any other Federal funds after enactment, from requiring an individual to have received a COVID-19 vaccination as a condition of providing any service to that individual. It also requires an entity that violates this prohibition to repay the Government an amount equal to all Federal funds the entity received. The section defines “COVID-19 relief package” to include the CARES Act, the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020, the Families First Coronavirus Response Act, the Paycheck Protection Program and Health Care Enhancement Act, the Consolidated Appropriations Act, 2021, and the American Rescue Plan Act of 2021.
