H.R. 1210 — Protecting Taxpayers’ Wallets Act of 2025

This section establishes the short title of the Act as the “Protecting Taxpayers’ Wallets Act of 2025.”

This section adds a new 5 U.S.C. § 7136 requiring each agency to charge each labor organization recognized as the exclusive representative of its employees a quarterly fee for the use of agency resources, equal to the value of union time used by labor representatives while on duty and the value of agency resources provided for union use during that quarter. It requires agencies to notify labor organizations of the fee not later than 30 days after the end of each calendar quarter, makes payment due not later than 60 days after notice, and directs agencies to transfer all payments to the general fund of the Treasury. This section also requires agency heads to determine fee values using the labor representative’s hourly pay multiplied by union-time hours and, for agency resources, General Services Administration rates where available or market rates otherwise, with only the union-use portion counted for mixed-use resources. It bars those determinations from being treated as unfair labor practices, from collective bargaining or grievance procedures under chapter 71, and from other review or appeal. This section establishes enforcement penalties for nonpayment by increasing unpaid fees at the interest rate and, beginning 90 days after the payment becomes due, requiring agencies to deny further union time, stop providing further agency resources for union use, and cease being subject to grievance procedures, binding arbitration under 5 U.S.C. § 7121, and unfair labor practice complaints or proceedings related to the labor organization or represented employees. It further requires agencies, beginning 180 days after nonpayment begins, to terminate and stop authorizing payroll allotments under 5 U.S.C. § 7115, to notify the Federal Labor Relations Authority and the labor organization after 365 days, and requires the Authority to terminate the organization’s certification as exclusive representative after 380 days. It also prohibits recertification unless the organization pays all fees owed, including any interest increases.
