§2. Inclusion of certain retired public safety officers in the public safety officers' death benefits program
This section adds a new eligibility category under the Public Safety Officers’ Benefits program for retired law enforcement officers. It makes a retired law enforcement officer eligible for a death or permanent and total disability benefit if the officer dies or becomes permanently and totally disabled as the direct and proximate result of a personal injury caused by a targeted attack because of the officer’s service as a law enforcement officer. It defines a “retired law enforcement officer” as an individual who separated from service in good standing as a law enforcement officer in an official capacity at a public agency, with or without compensation.
This section also makes the change retroactive to the date of enactment and applies it to matters pending before the Bureau of Justice Assistance or otherwise on that date, as well as to claims filed or accruing after that date. It further applies the amendment to actions taken against covered retired law enforcement officers on or after August 28, 2012.
