H.R. 1282 — Eliminate DEI in Colleges Act

This section provides the short title of the Act as the “Eliminate DEI in Colleges Act.”

This section prohibits an institution of higher education from receiving any Federal funds or other financial assistance, including participation in any federally funded or guaranteed student loan program, unless the institution certifies to the Secretary of Education that it does not and will not carry out any program, project, initiative, or other activity whose primary purpose is to advocate, promote, or otherwise support diversity, equity, and inclusion, and does not and will not maintain any office or other entity for that purpose. It also requires institutions that provide the certification to make available, upon request, any information needed to verify the certification, directs the Secretary to issue regulations to implement and enforce the section, and establishes an appeals process under which an institution may appeal a termination of assistance within 30 days of notice, with a hearing before an administrative law judge within 45 days of the appeal, subject to extension on the institution’s motion. For purposes of this section, “diversity, equity, and inclusion” means classifying individuals on the basis of race, color, sex, national origin, gender identity, or sexual orientation and affording differential or preferential treatment on that basis.
