H.R. 1311 — Stop the Delta Tunnel Act

This section establishes the short title of the Act as the “Stop the Delta Tunnel Act.”

This section prohibits the Secretary of the Army, acting through the Chief of Engineers, from issuing any permit under section 404 of the Federal Water Pollution Control Act (33 U.S.C. 1344) for the Delta Conveyance Project described in the U.S. Army Corps of Engineers’ December 2022 “Delta Conveyance Project Draft Environmental Impact Statement.” (Thus, the Corps could not authorize the discharge of dredged or fill material into navigable waters for that project.)
