H.R. 1312 — No Asylum for Criminals Act of 2025

This section establishes the short title of the Act as the “No Asylum for Criminals Act of 2025.”

This section revises the criminal bars to asylum under 8 U.S.C. § 1158 by making an alien ineligible if the alien has been finally convicted of a felony or misdemeanor, except for political offenses committed outside the United States that the Secretary of Homeland Security designates by regulation. It defines “felony” as any crime classified as a felony by the relevant Federal, State, tribal, or local jurisdiction of conviction or any crime punishable by more than 1 year of imprisonment, and it defines “misdemeanor” as any crime classified as a misdemeanor by the relevant jurisdiction or any crime not punishable by more than 1 year of imprisonment. (Thus, the amendment broadens the asylum crime bar to cover final convictions for both felonies and misdemeanors, while preserving a limited regulatory exception for certain foreign political offenses.)
