H.R. 1320 — Modern Worker Security Act

This section establishes the short title of the Act as the “Modern Worker Security Act.”

This section prohibits Federal agencies and courts, beginning on the date of enactment, from considering whether a person provides a benefit to an individual when determining whether the individual is an employee of that person under any Federal law. It defines “benefit” to include: (1) a benefit or protection provided for work performed that the individual may keep even if the work relationship ends; (2) benefits commonly provided to full-time employees, including workers’ compensation, skills training, professional development, paid leave, disability coverage, health insurance coverage, retirement savings, and short-term savings; and (3) any contribution, financial or otherwise, toward such a benefit made by the person, the individual, or both.
