H.R. 1338 — REPLACE Act

This section establishes the short title of the Act as the “Replacing Essential Passports and Licenses After Certain Emergencies Act” or the “REPLACE Act.”

This section revises the critical document fee waiver authority in the Disaster Recovery Reform Act of 2018 by requiring the President, in consultation with the Governor of a State, to provide a fee waiver to any individual or household adversely affected by a major disaster declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170) if the President provides individual and household assistance under section 408 of that Act (42 U.S.C. 5174) and the disaster destroyed a critical document covered by the waiver. It also requires the Department of State and U.S. Citizenship and Immigration Services (USCIS) to publicly post notice of the waiver availability on their websites and directs USCIS and the Secretary of State to submit annual reports to Congress, beginning not later than 1 year after enactment and every year thereafter, on the number of waivers granted and the cost of granting them. The section redesignates the existing paragraph (4) as paragraph (8).
