H.R. 1349 — Women’s Protection in Telehealth Act

This section provides the short title of the Act as the “Women’s Protection in Telehealth Act.”

This section excludes individuals and entities that prescribe, administer, dispense, or furnish abortion-inducing drugs from participation in the Medicare program under title XVIII of the Social Security Act unless they are a physician, physically examine the patient, are physically present in the same room when the patient takes the drug, and schedule an in-person follow-up visit within 14 days. It adds a new mandatory exclusion category under section 1128(a)(5) of the Social Security Act (42 U.S.C. 1320a–7) for conduct occurring on or after the date of enactment, defines “abortion-inducing drug” to include any medicine or substance used to terminate a clinically diagnosable pregnancy with knowledge that the termination will likely cause the death of the unborn child, and incorporates the definition of “unborn child” from 18 U.S.C. § 1841. It makes the exclusion permanent, and it bars the usual waiver, notice, and hearing provisions from applying to exclusions under this new paragraph.
