H.R. 1365 — America First Energy Act

This section establishes the short title of the Act as the “America First Energy Act.”

This section revises the membership and staffing restrictions for the Foundation for Energy Security and Innovation under 42 U.S.C. § 19281 by (1) prohibiting any Department of Energy employee from serving as a voting member of the Board and requiring each voting Board member to be a U.S. citizen, U.S. national, refugee admitted under section 207 of the Immigration and Nationality Act (8 U.S.C. 1157), or lawful permanent resident, and (2) requiring the Executive Director and each officer or employee of the Foundation to meet the same citizenship or immigration-status requirements. This section also directs that the Foundation be carried out in accordance with subtitle D of the Act and section 223 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (42 U.S.C. 6605), which imposes security-related requirements on Department of Energy activities.
