H.R. 1376 — Healthy Poultry Assistance and Indemnification Act of 2025

This section establishes the short title of the Act as the “Healthy Poultry Assistance and Indemnification Act of 2025.”

This section revises the Animal Health Protection Act compensation authority under 7 U.S.C. § 8306 by renaming subsection (d) to apply to “destroyed animals” and establishing a new compensation program for poultry growers and layers in control areas. As background, the Animal and Plant Health Inspection Service (APHIS) uses control areas to restrict animal movement and reduce the spread of poultry diseases. The new subsection (e) defines a “control area” as a Control Area determined by the APHIS Administrator and defines “poultry” to include domesticated fowl bred primarily for eggs or meat, including chickens, turkeys, ostriches, emus, rheas, cassowaries, waterfowl, and game birds, but excluding doves and pigeons. It requires the Secretary to compensate the owner of a poultry growing or laying facility for flocks the owner was prohibited from growing or laying because the facility was located within a control area. The compensation amount is based on the average income from the 5 most recent flocks multiplied by the number of flocks the owner was prohibited from growing or laying while the control area was in effect, reduced by any compensation the owner received from a State or other source for the same flocks. The Secretary’s determination of the payment amount is final and not subject to judicial review or review by any Federal officer or employee other than the Secretary or the Secretary’s designee. The Secretary must pay compensation not later than 60 days after the owner submits a request. The section also applies the exceptions in subsection (d)(3) to the new poultry compensation program and bars payment under subsection (e) to an owner who received compensation under subsection (d) for a facility in the same control area during the same period of time.
