H.R. 1421 — Make American Flags in America Act of 2025

This section establishes the short title of the Act as the “Make American Flags in America Act of 2025.”

This section establishes a requirement that a flag of the United States displayed on Federal property or procured with Federal funds be 100 percent made in the United States. It prohibits a Federal agency from displaying a U.S. flag on Federal property unless the flag was made in the United States, and prohibits the use of appropriated or otherwise available Federal funds to procure a U.S. flag unless the flag was made in the United States. As background, the new provision applies to Executive agencies, military departments, legislative branch offices and agencies, judicial branch offices and agencies, the Government of the District of Columbia, and Government-controlled corporations, and defines Federal property to include real property owned, leased, or occupied by a Federal agency or a wholly owned U.S. instrumentality. It defines “made in the United States” to mean 100 percent manufactured in the United States from articles, materials, or supplies that are 100 percent produced or manufactured in the United States. The section requires implementation consistent with U.S. obligations under international agreements and clarifies that it does not apply to private actors. It applies to flag display beginning 2 years after enactment and to flag procurement beginning 90 days after enactment.

This section directs the Chair of the Federal Trade Commission to conduct a study of the enforcement scheme for country-of-origin labeling for flags of the United States, including how the scheme is enforced, how many fines or penalties have been imposed for violations, and what percentage of violations are subsequent violations by entities previously found to have violated the scheme. It also requires the Chair to submit a report to the House Committee on Energy and Commerce and the Senate Committee on Commerce, Science, and Transportation not later than 1 year after enactment containing the study results and recommendations to improve the enforcement scheme and its deterrent effect.
