H.R. 1436 — ENABLE Act

This section establishes the short title of the Act as the “Ensuring Nationwide Access to a Better Life Experience Act” or the “ENABLE Act.”

This section permanently extends the higher contribution limit for Achieving a Better Life Experience (ABLE) accounts by striking the sunset date of January 1, 2026, under 26 U.S.C. § 529A(b)(2)(B)(ii). It also revises the retirement savings contribution credit under 26 U.S.C. § 25B to treat ABLE account contributions as qualified retirement savings contributions for taxable years, and for taxable years beginning before January 1, 2027, to continue counting traditional retirement contributions, elective deferrals, deferred compensation under section 457(b), and voluntary employee contributions. In addition, it repeals section 103(e)(1) of the SECURE 2.0 Act of 2022 and directs that the Internal Revenue Code be applied as though that paragraph had never been enacted. The amendments apply to taxable years ending after the date of enactment.

This section permanently extends the ability to roll over funds from a qualified tuition program under section 529 of the Internal Revenue Code of 1986 into an Achieving a Better Life Experience (ABLE) account by striking the January 1, 2026, expiration date. (Thus, tax-free rollovers from 529 plans to ABLE programs remain available for distributions made after the date of enactment.)
