H.R. 1458 — VETS Opportunity Act of 2025

This section provides the short title of the Act as the “Veterans Education and Technical Skills Opportunity Act of 2025” or the “VETS Opportunity Act of 2025.”

This section revises the timing and payment mechanism for repayment of certain Post-9/11 Educational Assistance contributions under 38 U.S.C. § 3327, effective August 1, 2026. It changes the payment deadline in subsection (f)(3) to require payment not later than 60 days after the relevant event, rather than “together” with the existing payment timing language, and adds a new subsection (f)(4) for individuals who elect Post-9/11 educational assistance under subsection (a) as described in subparagraph (A), (C), or (E) of paragraph (1) and who are not eligible for a monthly housing stipend under 38 U.S.C. § 3313(c). For those individuals, the educational assistance is paid in a lump sum equal to the total amount of their contributions multiplied by the sum of the months described in paragraph (1)(B)(i)(I) and (II), and paid not later than 60 days after the individual exhausts entitlement to educational assistance under this chapter. The section also makes conforming changes by limiting a cross-reference from paragraphs (2) through (7) to paragraphs (2) through (6) and revising the heading of paragraph (1) to specify that the existing “Additional assistance” provision applies to an individual eligible for a monthly housing stipend.

This section revises the Department of Veterans Affairs’ rules for approving independent study programs for education benefits by requiring that the course of study include regular and substantive interaction between students and instructors and by adding a new qualifying category for programs offered by an institution of higher education, as defined in section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002), that is approved to participate in, or is participating in, Title IV student financial assistance programs. It also changes the existing list of qualifying program types by replacing the prior “; or” and “; and” connectors in section 3680A(a)(4)(A)(ii)(III) with semicolons and adding a new item (cc). The amendment applies to any quarter, semester, or term beginning on or after August 1, 2026.

This section revises 38 U.S.C. § 3691A to allow a covered member, after receiving orders to enter a period of covered service, to (1) withdraw from covered education, (2) take a leave of absence from covered education, or (3) subject to a new requirement, enter into an agreement with the institution to complete the course to the institution’s satisfaction. It also makes a conforming amendment to clarify that the statute applies when a covered member “takes a leave of absence” or “enters into an agreement,” and adds a new condition that a covered member may enter into such an agreement only after completing at least half of the course of covered education. The section further redesignates the existing subsection (d) as subsection (e) and updates the section heading and table of sections to reflect the new title, “Absence from certain education due to certain service.”

This section revises the notice requirements for Department of Veterans Affairs compliance surveys of educational institutions and training establishments under 38 U.S.C. § 3693. It requires the Department to provide not fewer than 10 and not more than 15 business days’ notice for institutions or training establishments with a time stamp database collection feature, and not more than 10 business days’ notice for all other institutions or training establishments, instead of the prior requirement of not more than 10 business days’ notice for all surveys. It also defines “school certifying official” as an employee of an educational institution with primary responsibility for certifying veteran enrollment, and incorporates the existing statutory definitions of “educational institution” and “training establishment” from 38 U.S.C. § 3452.

This section requires the Secretary of Veterans Affairs to notify all school certifying officials within 14 business days after updating the Department of Veterans Affairs school certifying official handbook. It defines a school certifying official as an employee of an educational institution whose primary responsibility is certifying veteran enrollment at that institution.

This section extends the limit on pension payments under 38 U.S.C. § 5503(d)(7) through May 31, 2034 (from January 31, 2033).
