H.R. 1526 — No Rogue Rulings Act of 2025

This section establishes limitations on the authority of U.S. district courts to issue injunctive relief by adding a new section to chapter 85 of title 28, United States Code (28 U.S.C. §1370). Generally, district courts may not issue injunctions except those applicable only to a party to the case or non-parties represented by that party under the Federal Rules of Civil Procedure. (Thus, district courts are prohibited from issuing nationwide injunctions binding non-parties absent such representation.) As an exception, cases brought by two or more states from different circuits challenging executive branch actions must be referred to a randomly selected three-judge panel under 28 U.S.C. §2284 (with selection not by the chief judge); the panel may issue an otherwise prohibited injunction after considering the interest of justice, risk of irreparable harm to non-parties, and constitutional separation of powers, with appeals available to the relevant circuit or the Supreme Court at the appellant's preference. The section also updates the table of sections for chapter 85.
