H.R. 1528 — America Works Act of 2025

This section revises exceptions to the Supplemental Nutrition Assistance Program (SNAP) able-bodied adults without dependents (ABAWD) three-month benefit time limit under section 6(o)(3) of the Food and Nutrition Act of 2008 to exempt (1) individuals under 18 or over 65 years of age, (2) individuals medically certified as physically or mentally unfit for employment, (3) parents or other household members responsible for a dependent child under 7 years of age, (4) individuals otherwise exempt under subsection (d)(2), and (5) pregnant women. This section further revises the waiver provision under section 6(o)(4)(A) to authorize the Secretary, upon request by a state agency and with support from the state's chief executive officer, to waive the ABAWD requirement for individuals in counties or county-equivalents with an unemployment rate over 10 percent. This section strikes subsection (b) of section 311 of title II of division C of the Fiscal Responsibility Act of 2023 (Public Law 118-5).
