H.R. 1535 — BAD DOGE Act

This section declares 15 congressional findings that the United States DOGE Service (USDS) and U.S. DOGE Service Temporary Organization (USDSTO), established by Executive Order 14158 as a temporary organization under 5 U.S.C. §3161(a) (i.e., limited to a specific study or project for no more than three years), have exceeded their scope under the leadership of Elon Musk (who lacks formal appointment as USDS Administrator or compliance with special government employee requirements); have engaged in unauthorized actions (e.g., freezing agency payments, accessing Office of Personnel Management personnel data and Treasury Bureau of Fiscal Service payment systems, locking employees out of systems, offering buyouts, and attempting to terminate agencies and programs); and have violated constitutional provisions (e.g., separation of powers, appropriations, spending, and take care clauses) and federal statutes (e.g., Congressional Budget and Impoundment Control Act of 1974, Anti-Deficiency Act, Privacy Act of 1974, Federal Information Security Modernization Act of 2014, Federal Advisory Committee Act, and Administrative Procedure Act).
