H.R. 1541 — Wireless Broadband Competition and Efficient Deployment Act

This section exempts federal authorizations for covered projects from being considered major federal actions under the National Environmental Policy Act of 1969 (NEPA, 42 U.S.C. 4332(2)(C)) and exempts such projects from being considered undertakings under the National Historic Preservation Act (NHPA, 54 U.S.C. 300320). A covered project is the mounting or installation of an eligible personal wireless service facility (i.e., antennas, equipment, cabling, or cabinets) with an existing eligible facility, or the modification of an eligible facility, for which a complete request is filed with a state or local government (including the District of Columbia and territories) or an Indian tribe (as defined in 25 U.S.C. 5130) and that requires FCC approval or is subject to FCC jurisdiction. (Thus, these collocations and modifications avoid NEPA environmental reviews and NHPA historic preservation reviews.)
