H.R. 159 — CLEAN Public Service Act

This section terminates further retirement coverage for Members of Congress (excluding the Vice President) under the Civil Service Retirement System (CSRS, which provides defined benefit pensions to certain pre-1984 federal hires) and Federal Employees Retirement System (FERS, which provides pensions, Thrift Savings Plan matching contributions, and Social Security integration to post-1983 hires), effective 90 days after enactment. Specifically, the section (1) inserts new section 8335a in CSRS (5 U.S.C. Ch. 83, Subch. III) to end coverage, Government contributions, and basic pay deductions to the Civil Service Retirement and Disability Fund for service after that date; and (2) inserts new section 8425a in FERS (5 U.S.C. Ch. 84, Subch. II) to end such coverage for Members first elected before enactment (after that date) or at all for Members first elected on or after enactment, with refunds of lump-sum credits for those with less than five years of civilian service. (Thus, Members accrue no further defined benefit pension credits but retain eligibility for Thrift Savings Plan participation and all pre-enactment rights.) The section authorizes regulations by the Office of Personnel Management (except Thrift Savings Plan matters by its Executive Director) and makes conforming clerical amendments to chapter tables of sections.
