H.R. 1598 — Ensuring Access to Medicaid Buy-in Programs Act

This section removes the upper age limit of 65 years old for Medicaid's optional eligibility group for working individuals with a medically improved disability under subclause (XV) of section 1902(a)(10)(A)(ii) and for the related definition of such individuals in section 1905(v)(1)(A) (i.e., to no upper age limit from under 65 years old). (As background, these buy-in provisions—enacted under the Ticket to Work and Work Incentives Improvement Act of 1999—allow states to elect Medicaid coverage for employed adults with disabilities who exceed traditional income and resource limits by paying a premium, thus enabling them to work without losing health coverage.) States currently providing such coverage under subclause (XV) or (XVI) are not regarded as noncompliant with the amendments before January 1, 2027.
