H.R. 1617 — Wireless Resiliency and Flexible Investment Act of 2025

This section revises the eligible facilities request approval process under Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012 (47 U.S.C. 1455(a))—which requires state and local governments to approve modifications to existing wireless towers or base stations that do not substantially change physical dimensions (i.e., collocation, removal, or replacement of transmission equipment)—as follows: (1) expands applicability to state or local government instrumentalities and to modifications of eligible support structures (e.g., certain utility poles); (2) replaces the definition of eligible facilities request with a 60-day timeframe for state or local government approval, after which an unapproved request (absent specific written denial notice citing applicable rules) is deemed approved, with tolling for incomplete initial requests (up to 30 days) or supplemental submissions (up to 10 days) and by mutual agreement; (3) updates the environmental laws cross-reference from paragraph (1) to the full subsection; and (4) specifies that a request is submitted upon the requesting party's first procedural step under local processes.
