H.R. 1619 — No Funds for Fascists Act

This section prohibits the obligation or expenditure of funds authorized for foreign assistance—including under the Foreign Assistance Act of 1961—for any fiscal year beginning on or after enactment to a foreign government if the Secretary of State determines that the government or an employee acting under its official authority or influence (i.e., employees, heads of state or government, or contractors) abridges or censors speech protected by the U.S. Constitution and uses any communication to direct, coerce, compel, encourage, or request a covered platform to censor such speech. Covered platforms include interactive computer services, as defined in Section 230(f) of the Communications Act (i.e., services enabling computer access to the Internet or facilitating online interactions), and any platform used by media organizations to disseminate information. The Secretary must publish each determination in the Federal Register, and the President may waive the prohibition for national security interests after consulting specified congressional committees and submitting a report detailing the country, interests, assistance, and waiver duration at least 15 days prior to effectiveness.
