H.R. 1627 — TREATS Act

This section revises the definition of valid prescription for Internet-dispensed controlled substances (i.e., those requiring a prescription issued for a legitimate medical purpose by a practitioner who conducted at least one patient evaluation or by a covering practitioner) to allow, as an alternative to one in-person medical evaluation, one telehealth evaluation for prescribing schedule III, IV, or V substances approved by the FDA for substance use disorder treatment (previously, required at least one in-person medical evaluation). It defines telehealth evaluation as a remote medical evaluation by a practitioner (other than a pharmacist), using two-way real-time audio-only or audio-video telecommunications referred to in Medicare telehealth provisions (42 U.S.C. 1395m(m)), in accordance with applicable federal and state laws.
