H.R. 1644 — Copay Fairness for Veterans Act

This section eliminates Department of Veterans Affairs (VA) copayments for (1) medications that are or are part of preventive health services, by adding them to the list of exempt medications under 38 U.S.C. 1722A(a)(3); and (2) preventive health services under hospital care and medical services provisions, by adding exemptions under 38 U.S.C. 1710(f)(5) and (g)(3)(C). It defines "preventive health services" under 38 U.S.C. 1701(9) to include (L) evidence-based items or services with an "A" or "B" rating from the U.S. Preventive Services Task Force; (M) immunizations recommended by the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention for the individual; and (N) for women, preventive care, screenings, and contraceptives per Health Resources and Services Administration guidelines as of December 30, 2022, plus any FDA-approved contraceptives and related care.
