H.R. 1736 — Generative AI Terrorism Risk Assessment Act

This section states the sense of Congress that (1) the heightened terrorism threat landscape and increasing use of generative artificial intelligence by foreign terrorist organizations constitute a national security threat that is not well understood; and (2) the Department of Homeland Security (DHS), in consultation with the Office of the Director of National Intelligence, must take steps to recognize, assess, and address such threat to reduce risks to the people of the United States.

This section requires the Secretary of Homeland Security, in consultation with the Director of National Intelligence, to submit to specified congressional committees (i.e., designated House and Senate homeland security, intelligence, and commerce committees) an annual assessment of terrorism threats to the United States posed by foreign terrorist organizations' or individuals' use of generative artificial intelligence—not later than one year after enactment of this Act and annually thereafter for five years. Each assessment must (1) analyze incidents from the prior calendar year involving such actors' use or attempted use of generative artificial intelligence to spread violent extremist messaging, radicalize or recruit individuals, or enhance development or deployment of chemical, biological, radiological, or nuclear weapons; and (2) provide recommendations for countermeasures; assessments must be coordinated for privacy and civil liberties protections, submitted unclassified (with a classified annex), posted publicly on a DHS website (excluding sensitive information), and followed by a congressional briefing within 30 days (with participation by other agency heads as appropriate). The section further requires DHS to review, incorporate, and disseminate to state, major urban area, and National Network of Fusion Centers any relevant terrorism threat information on generative artificial intelligence gathered by those centers and directs the Office of the Director of National Intelligence, Federal Bureau of Investigation, intelligence community members, and other relevant agencies to share such information with DHS. The section defines "generative artificial intelligence" (i.e., AI models generating synthetic content such as images, videos, audio, or text) and cross-references existing statutory definitions for "artificial intelligence," "foreign terrorist organization," "fusion center," "intelligence community," and "terrorism."
