H.R. 174 — Consequences for Social Security Fraud Act

This section amends the Immigration and Nationality Act to establish new grounds of inadmissibility and deportability for any alien convicted of, who admits having committed, or who admits committing acts constituting the essential elements of (1) a covered COVID offense (i.e., fraud pertaining to loans made under paragraphs (36) or (37) of section 7(a) of the Small Business Act [15 U.S.C. 636(a)], subsection (b) of such section 7 in response to COVID-19 [i.e., Economic Injury Disaster Loans], grants under section 5003 of the American Rescue Plan Act [15 U.S.C. 9009c; i.e., Restaurant Revitalization Fund], or section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act [15 U.S.C. 9009a; i.e., Shuttered Venue Operators Grant program]); (2) an offense under section 208 of the Social Security Act (42 U.S.C. 408) relating to social security account numbers or cards; (3) an offense under section 1028 of title 18, United States Code, relating to fraud and related activity in connection with identification documents; or (4) a conspiracy to commit such an offense.
