H.R. 1747 — Break the Chain Act

This section revises family-sponsored immigration priorities under the Immigration and Nationality Act as follows: (1) excludes parents of U.S. citizens from the definition of immediate relatives (previously unlimited visas for children, spouses, and parents of citizens who are at least 21 years of age), limiting it to children and spouses of citizens; (2) establishes a new worldwide level of family-sponsored immigrants at 87,934 for a fiscal year, minus aliens paroled in the second preceding fiscal year who did not depart within 365 days (without advance parole) and either did not adjust to lawful permanent resident status in the two preceding fiscal years or adjusted under a provision exempting them from numerical limits; (3) limits family preference visas under INA §203(a) to spouses and minor children of lawful permanent residents, allocated according to the new worldwide level (eliminating prior categories for adult children, married children, and siblings of citizens and adult children of permanent residents); (4) modifies aging-out protections under INA §203(h) by basing child status on age at petition filing (rather than visa availability), with a new limitation that an alien no longer qualifies if they marry or turn 25 before a visa becomes available; (5) makes conforming amendments throughout the INA to reflect these changes, including updates to nonimmigrant V visas, petition procedures, inadmissibility waivers, and deportation provisions; and (6) creates a new nonimmigrant W classification for parents of adult U.S. citizens, subject to INA §214(s).
