H.R. 1748 — FEMA for America First Act of 2025

This section establishes restrictions on alien eligibility for individual disaster assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (i.e., Stafford Act). Only qualified aliens—as defined in section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (8 U.S.C. 1641), excluding (1) asylees who have not sought adjustment to lawful permanent resident status under INA §209(b), (2) refugees who have not sought such adjustment under INA §209(a), and (3) aliens paroled into the United States under INA §212(d)(5)—are eligible. (Thus, certain humanitarian immigrants remain ineligible for Stafford Act individual assistance such as temporary housing, crisis counseling, and disaster unemployment assistance.)
