H.R. 175 — Deport Alien Gang Members Act

This section amends the Immigration and Nationality Act (INA) to address aliens associated with criminal gangs by (1) defining "criminal gang" in INA §101(a)(53) as an ongoing group, club, organization, or association of 5 or more persons with a primary purpose of committing specified offenses (e.g., controlled substance offenses punishable by more than one year imprisonment, firearms or body armor offenses under 18 U.S.C. §931, crimes of violence under 18 U.S.C. §16(a), human trafficking, or racketeering) within the past five years, or as designated by the Secretary of Homeland Security (DHS); (2) adding inadmissibility grounds in INA §212(a)(2)(J) for aliens known or reasonably believed to be or have been criminal gang members, to have participated in gang activities, or to enter the United States in furtherance of such activities; (3) adding deportability grounds in INA §237(a)(2)(G) for aliens who are or have been criminal gang members or have participated in gang activities; and (4) directing DHS, in consultation with the Attorney General, to designate criminal gangs under new INA §220 via congressional notification, Federal Register publication, and an administrative record that may include classified information.
