H.R. 1829 — Apache County and Navajo County Conveyance Act of 2025

This section directs the Secretary of Agriculture, upon written request by Navajo County, Arizona, within 180 days of enactment, to convey to the county without consideration, by quitclaim deed, approximately 5 acres (two parcels of 2.5 acres each) of National Forest System land in the Apache-Sitgreaves National Forests depicted on the specified map, for use as a cemetery. The conveyance is (1) exempt from notice and covenant requirements under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) (42 U.S.C. 9620(h)) (i.e., no deed notice of potential hazardous substance activity or warranty of remedial action); (2) subject to valid existing rights, reversion to the United States if not used as a cemetery, and other terms protecting U.S. interests; and (3) conditioned on the county paying all associated costs, including survey and environmental analysis.

This section directs the Secretary of Agriculture to convey to Apache County, Arizona, without consideration and by quitclaim deed, approximately 10.62 acres (2.56 acres depicted as the "Existing Alpine Cemetery" and 8.06 acres as the "Proposed Townsite Tract") of National Forest System land in the Apache-Sitgreaves National Forests, as depicted on a specified map dated October 2019, if the county submits a written request within 365 days of enactment. The conveyance is exempt from covenants required under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) (42 U.S.C. 9620(h)) (i.e., assurances that necessary remedial action for hazardous substances has been or will be taken); is subject to valid existing rights and any other terms the Secretary considers appropriate; requires the county to pay all associated costs, including survey and environmental analysis; and provides for reversion to the United States if the land is not used as a cemetery.
