H.R. 1839 — Move the ICC Out of NYC Act of 2025

This section states six congressional findings concerning U.S. participation in the United Nations, including Senate ratification of the UN Charter in 1945; enactment of the United Nations Headquarters Agreement Act in 1947 to authorize the UN headquarters in New York, New York; non-ratification of the Rome Statute of the International Criminal Court; the ICC's lack of jurisdiction in or over the United States; the ICC's office at UN headquarters; and amendments to the Headquarters Agreement negotiated by the U.S. Ambassador to the United Nations.

This section establishes definitions for this Act, including (1) "International Criminal Court" and "Rome Statute," which have the meanings given those terms in section 2013 of the American Service-Members’ Protection Act (22 U.S.C. 7432); and (2) "United Nations Headquarters Agreement," meaning the agreement signed at Lake Success on June 26, 1947, and entered into force on November 21, 1947, between the United Nations and the United States.

This section directs the United States Ambassador to the United Nations, not later than 30 days after the opening date of the 80th session of the United Nations General Assembly, to seek negotiations for a supplemental agreement to the United Nations Headquarters Agreement. The supplemental agreement would prohibit the United Nations from hosting, leasing, or otherwise allowing use of its facilities within the United States by the International Criminal Court.
