H.R. 184 — Action Versus No Action Act

This section limits environmental assessments and environmental impact statements under the National Environmental Policy Act of 1969 (NEPA) to two alternatives—the proposed forest management activity and no action—for activities on lands identified as suitable for timber production that meet at least one of the following conditions: (1) occur on lands designated by the Secretary concerned under section 602(b) of the Healthy Forests Restoration Act of 2003 (HFRA); (2) are developed through a collaborative process (as defined in HFRA section 603(b)(1)(C)); (3) are proposed by a resource advisory committee (as defined in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000); or (4) are covered by a community wildfire protection plan (CWPP, as defined in HFRA section 101). For the no-action alternative, the Secretary concerned (the Secretary of Agriculture for National Forest System lands or the Secretary of the Interior for public lands) must consider effects on forest health, potential losses of life and property, habitat diversity, wildfire potential, insect and disease potential, and timber production, as well as implications of related declines for losses of life and property, domestic water supply, wildlife habitat loss, and other economic and social factors.
